7) Limitation of liability
FunkyBreslev uses reasonable means to ensure the availability and security of the site. However, FunkyBreslev cannot be held liable for service interruptions, bugs, viruses, or indirect damages related to the use of the site, except in cases of gross negligence, willful misconduct or personal injury. This clause does not affect the rights consumers hold under the mandatory provisions of the French Consumer Code and Civil Code, in particular the legal guarantee of conformity and the guarantee against hidden defects.
8) Governing law and jurisdiction
This legal notice is governed by French law.
For disputes with a consumer, the jurisdiction rules of the French Consumer Code and Regulation (EU) No 1215/2012 (Brussels I bis) apply: the consumer may bring proceedings, at their choice, before the courts of their place of residence or those of the defendant.

1. Purpose
These Terms of Sale govern sales of digital and physical products between FunkyBreslev (the “Seller”) and any non-trading adult individual (the “Customer” or “Consumer”) via the funkybreslev.com website.
Any order placed on the site implies full and unreserved acceptance of these Terms by the Customer, acknowledged via a checkbox before order confirmation. The applicable Terms are those in force on the date the order is confirmed.

3. Products
The Seller offers the following product categories. All prices are displayed in euros (€) on funkybreslev.com at the time of purchase and may change at any time without notice. Prices are inclusive of all taxes (VAT not applicable, art. 293 B CGI).
3.1 — Digital products
The Collection — Download: the complete FunkyBreslev discography available on the order date, in mastered MP3 format (320 kbps), delivered as an instant-download archive. The catalog grows continuously: the number of tracks included corresponds to the catalog available at the time of the order.
The Drop — quarterly catalog update: the new tracks produced since the previous Drop, in mastered MP3 format (320 kbps), as an instant download. The Drop is reserved for Customers who have previously purchased The Collection (USB key or download), upon verification of the key number or the email used for the order. Only Drops published after the purchase date of The Collection are offered to the Customer, as earlier tracks are already included in their Collection. The first Drop following the purchase is free; subsequent Drops remain available for purchase without time limit.
3.2 — Physical products
The Collection — USB key: a premium LEXAR 3.2 USB key (64 GB) containing the complete FunkyBreslev discography available on the order date, in mastered MP3 format (320 kbps), presented in a custom FunkyBreslev box with a hand-signed presentation booklet and premium envelope. Each key bears a unique number granting access to the Drops. Shipped from France by La Poste with tracking.
The Drop — USB key (option, + €7): for any quarterly Drop (including the first, free Drop), the Customer may choose to also receive the Drop's content on a dedicated USB key, shipped from France by La Poste with tracking, for a supplement of €7 added to the price of the Drop concerned.
The essential characteristics of each product (title, audio format, content) are specified on the corresponding product page.
4. Ordering
Orders are placed directly on funkybreslev.com. The process includes: product selection, cart validation, entry of required information (name, email, and shipping address for physical products), express acceptance of these Terms via checkbox, choice of payment method and payment, and an order confirmation sent by email.
For digital products: confirming the order, after accepting these Terms — article 7.1 of which informs the Customer of immediate delivery and waiver of the withdrawal right — constitutes express consent to immediate performance of the contract and explicit waiver of the withdrawal right in accordance with article L.221-28 13° of the French Consumer Code. This waiver is restated in the order confirmation email.
The order becomes final upon payment confirmation by the payment provider. The Seller reserves the right to refuse any order for legitimate reasons (abnormal order, suspected fraud, prior dispute).
5. Prices and payment
Prices are shown in euros, inclusive of all taxes (VAT not applicable, art. 293 B CGI). Any delivery charges for physical products are shown separately before order confirmation.
Payment is secure and handled by Stripe. Accepted payment methods are shown on the site at the time of ordering. The Seller stores no banking data.
6. Delivery
6.1 — Digital products (The Collection — Download, The Drop)
Instant download access after payment confirmation. A secure, personal, time-limited download link is sent by email. If the link expires, a new one can be obtained from the order email or on request at contact@funkybreslev.com.
6.2 — Physical products (The Collection — USB key, The Drop — USB key)
USB keys are shipped from France by La Poste with a tracking number. A confirmation email with the tracking number is sent upon shipment.
Delivery charges: France: delivery included in the displayed price. International: flat rate shown before order confirmation, tracked delivery.
Estimated delivery time: 2 to 4 working days in France; 7 to 20 days internationally depending on destination. Any customs duties, import taxes or clearance fees applied by the destination country are borne exclusively by the Customer.
The Seller cannot be held liable for delivery delays attributable to the carrier or to the customs services of the destination country.
If a parcel is declared lost by the carrier (following an inquiry with La Poste), the Seller will reship the product or fully refund the Customer, at the Customer's choice.
Retention of title: physical products remain the Seller's property until full payment of the price by the Customer.
7. Right of withdrawal
7.1 — Digital products (The Collection — Download, The Drop)
In accordance with article L.221-28 13° of the French Consumer Code, the Customer expressly waives their right of withdrawal at the time of ordering. This waiver results from: the express acceptance of these Terms via checkbox before order confirmation (article 7.1 clearly informing the Customer of immediate delivery and waiver of the withdrawal right), and the order confirmation email restating said waiver.
Consequently, no withdrawal is possible once the download or access link has been received. All sales of digital products are final.
7.2 — Physical products (The Collection — USB key, The Drop — USB key)
The Customer has 14 days from receipt of the product to exercise their right of withdrawal, in accordance with article L.221-18 of the French Consumer Code.
Exception: in accordance with article L.221-28 6° of the French Consumer Code, the right of withdrawal cannot be exercised for sealed goods containing digital content that have been unsealed after delivery. The USB keys (The Collection or The Drop) are shipped in their original sealed packaging (shrink wrap). Opening the sealed packaging constitutes access to the digital content and forfeits the right of withdrawal.
How to withdraw: the Customer notifies their decision by email to contact@funkybreslev.com or by post to the Seller's address, using the model withdrawal form appended to these Terms or any other unambiguous statement.
Return: the Customer returns the product in its original, intact and sealed packaging within 14 days of notifying withdrawal. Return costs are borne by the Customer.
Refund: in the event of a valid withdrawal, the Seller refunds all sums paid (excluding any additional initial delivery costs resulting from the choice of a delivery method more expensive than the standard one) within 14 days of receiving the returned product or proof of its shipment, using the same payment method as the original order.
8. Legal guarantees
Independently of these Terms, the Customer benefits from the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code — 2 years from delivery of the good, or from supply for digital content supplied in a single act) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code — 2 years from discovery of the defect). 9. Usage license
All products sold by FunkyBreslev are subject to a private, non-commercial listening license only.
The following are strictly prohibited without the Seller's prior written authorization: public broadcasting (social media, clubs, bars, shops, funfairs, etc.); audiovisual synchronization (advertising, film, series, online video, etc.); streaming on third-party platforms (Spotify, Apple Music, YouTube, etc.); resale, redistribution or file sharing; any professional or commercial use, direct or indirect.
Any breach constitutes infringement within the meaning of articles L.335-2 et seq. of the French Intellectual Property Code, subject to civil and criminal proceedings.
10. Specific conditions — The Collection — Download
Contains the complete FunkyBreslev discography available on the order date. Delivered as an instant download after payment confirmation, as an archive. Files provided in mastered MP3 format (320 kbps). The price evolves with the number of tracks in the catalog; the applicable price is the one displayed on the site at the time of the order. The Collection only includes tracks available on the purchase date; future releases are accessible through the Drops (article 12), the first of which is free. Private, non-commercial listening license per article 9.
11. Specific conditions — The Collection — USB key
Physical product: premium LEXAR 3.2 USB key (64 GB) in a custom FunkyBreslev box, with hand-signed presentation booklet and premium envelope. Contains the complete discography available on the order date, in mastered MP3 format (320 kbps). Each key bears a unique number. Access to Drop purchases (article 12) is granted using the key number or the email used for the order. The first Drop following the purchase is free. The price evolves with the number of tracks in the catalog; the applicable price is the one displayed at the time of the order. Shipped in original sealed packaging; opening the seal forfeits the right of withdrawal (see article 7.2). Private, non-commercial listening license per article 9.
12. Specific conditions — The Drop
Digital product: quarterly catalog update containing the new tracks produced since the previous Drop, in mastered MP3 format (320 kbps). Reserved for Customers who have previously purchased The Collection (USB key or download); access is granted using the key number or the email used for the order. Only Drops published after the purchase date of The Collection are offered, as earlier tracks are already included in the Customer's Collection. The first Drop following the purchase is free; subsequent Drops remain available without time limit, including skipped cycles. Sale is final upon receipt of the download link, per article 7.1.
USB key option (+€7): the Customer may request to also receive the Drop's content on a dedicated USB key, shipped from France by La Poste with tracking. This physical option is subject to articles 6.2 and 7.2 of these Terms (delivery, sealed packaging, right of withdrawal).

15. Liability
The Seller uses reasonable means to ensure site availability, integrity of delivered files and transaction security. However, the Seller cannot be held liable for service interruptions, data loss, bugs, viruses or indirect damages, except in cases of gross negligence, willful misconduct or personal injury. This clause does not affect the Customer's rights under the mandatory provisions of the French Consumer Code and Civil Code (see article 8).
16. Force majeure
The Seller shall not be liable for non-performance or delay caused by force majeure within the meaning of article 1218 of the French Civil Code (strike, natural disaster, pandemic, telecommunications network failure, etc.).
17. Personal data
The processing of personal data is governed by the Privacy Policy available on the site, compliant with the GDPR and the French Data Protection Act.
18. Intellectual property
All elements on funkybreslev.com (texts, images, audio and video productions, logos, visual identity, code) are protected by copyright. Any reproduction, representation or exploitation without prior written authorization is prohibited.
19. Amendments to the Terms
The Seller may amend these Terms at any time. The applicable Terms are those in force on the order confirmation date. Amended Terms take effect upon publication on the site.
20. Severability
If one or more provisions of these Terms are held invalid or unenforceable under a law, regulation or final court decision, the remaining provisions remain in full force.
21. Governing law and jurisdiction
